General Terms and Conditions of Customized Products UG ( hereinafter referred to as CP ).
1. General
These General Terms and Conditions apply to all purchase contracts concluded via CP’s online store between Customized Products UG and the customer in his capacity as a consumer. CP concludes purchase contracts exclusively with consumers in the sense of § 13 BGB. The General Terms and Conditions available on this website at the time of the conclusion of the contract are authoritative.
2. Conclusion of the contract
By pressing the button “Order”, or in case of the PayPal payment option “Pay now”, you make a binding purchase of the selected product(s). CP or PayPal will confirm this order immediately by e-mail to your specified e-mail address.
All order data will be displayed after completion of the input. All order data will be saved by CP. You have the possibility to print the invoice under “Print” and thereby save it at the same time.
3. Prices and delivery reservations
The purchase price displayed in CP’s online store at the time of the order, which includes the respective (applicable) statutory sales tax, is binding. CP delivers only to countries of the EU and Switzerland, and only in customary quantities, while stocks last.
All offers in CP’s online store are subject to confirmation and are non-binding. CP reserves the right to change or amend the entire offer, including parts of this published website or to delete it altogether. The reservation also includes the possibility of temporary or permanent discontinuation.
Incurring shipping costs are listed in the order data and shown separately.
4. Payment options
The existing payment options are displayed during the ordering process and are available,
- SOFORT bank transfer ( consider possible bank fees of your credit institution )
- Credit card ( Visa and Mastercard, payment service provider STRIPE Inc. )
- Giropay (payment service provider STRIPE Inc.)
- PayPal ( redirection during the order process to the website of the online provider PayPal )
- Apple Pay (payment service provider Apple Inc.)
You will not incur any additional costs from CP by using these payment options. The exclusion of certain payment methods is expressly reserved after a credit check.
5. Delivery
CP delivers exclusively to the EU and Switzerland, billing address and, if applicable, a different delivery address must be bindingly specified by you. The delivery to you will be communicated directly by the delivery service DHL. In the event of undeliverability for which you are responsible, additional shipping costs may be incurred for redelivery, which you must bear. These are the possible outward and return shipping costs.
6. Retention of title and set-off claims
The delivered goods remain property of CP until the complete payment of the agreed purchase price. Your right to offset with counterclaims only exists insofar as your counterclaims are undisputed or have been legally established. A right of retention to be effectively exercised by you requires your counterclaims to be based on the same contractual relationship.
7. Warranty
The liability for material defects is determined by the statutory provisions.
8. Cancellation policy
You have the right to cancel the purchase contract within 14 days without giving any reason. The revocation and return period begins with the receipt of the goods by you or a third party designated by you. The carrier ( delivery service ) is not a third party in the sense of this provision.
To exercise your right of withdrawal, you must clearly declare to CP that you wish to withdraw from this purchase contract. This explanation can take place by letter with post office dispatch to Customized Products UG, Rebhalde 15, 88142 Wasserburg or by E-Mail to info@pickyourangel.com. In this case, the dispatch of your notification before the expiry of the revocation period is sufficient to meet the deadline.
In the case of timely revocation, we will return all payments received from you, including shipping costs (delivery costs) to you. The repayment will be made immediately and at the latest within 14 days from the day on which CP has received the notification of your revocation of the purchase contract. Not included in the repayment are delivery costs chosen by you, which differ from the standard delivery of CP. The repayment by CP will be made within the same means of payment that you used to pay the purchase price.
The handing over or return of the goods by you has to take place immediately and in any case within 14 days at the latest. The period begins on the day on which you notify CP of the revocation of the purchase contract. If you send the goods before the expiry of the 14-day period, this period shall be deemed to have been observed. CP has the right to refuse the repayment until CP has received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
The direct costs of the return shipment are to be borne by you. You are only responsible for a loss of value of the goods if this is due to an unnecessary handling with regard to the functioning, condition and properties of the goods by you.
This ends the cancellation policy.
9. Applicable law
The law of the Federal Republic of Germany shall apply with the exception of the UN Convention on Contracts for the International Sale of Goods. Its applicability is hereby expressly excluded. This choice of law applies only insofar as the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has his habitual residence.
